Terms of Service
Last Updated: October 30, 2026
1. Who we are and what you're agreeing to
These terms are a contract between you and Fire Power Cloud LTD ("Fire Power Cloud", "we", "us"), a company registered in England and Wales. Company number 11982311. Registered address: Valley Farm, Warminster, Wiltshire, BA12 0LT.
By ordering or using any of our services, you agree to these terms. If you don't agree with them, don't use the service. You must be at least 18 years old to hold an account.
You agree to comply with all applicable laws of the United Kingdom and of your own jurisdiction. Malicious or unlawful activity results in immediate termination and full cooperation with law enforcement.
2. Your account
The information you give us when registering must be accurate and kept up to date. Accounts are for one person. You are responsible for keeping your login details confidential and for everything that happens under your account, including all activity on any IP address assigned to your service. Complaints we receive about activity on your IP will be passed to you to resolve.
You may not resell our services, or share access to them with people outside your account, without our written consent.
3. Ordering and activation
Activation is automatic and normally completes within minutes of payment. Where stock or other constraints cause a delay, activation can take up to 30 days. You are not billed until your service is activated: your paid period, and the refund window in section 5, both start on activation. You can cancel for a full refund at any time before activation.
3.1 Pre-orders
Pre-orders are charged once, up front. When the service activates, that payment covers your first month. Pre-order payments are refundable up to 14 days after you cancel the pre-order.
4. Payments and subscriptions
Payments are processed by Stripe. We never store your card number, security code or similar sensitive payment details.
Your subscription renews automatically each month until you cancel. Cancelling your service also cancels the subscription. If you forget to cancel and a renewal payment goes through, unused time on that period is not refundable.
Payment processing fees are included in our prices. If you request a refund before your service is set up or your pre-order completes, the transaction fees from the original payment may be deducted from the refund.
All prices shown on our website include VAT where applicable.
We can change our prices. We'll give you at least 14 days' notice before a price change takes effect on your subscription.
5. Refunds and cancellation
5.1 48-hour money-back guarantee
If you're not happy, request a refund within 48 hours of your service being activated and we'll give you your money back. This applies to all payment methods except e-checks (electronic checks). We may refuse refunds that fall outside these criteria or that we reasonably suspect are fraudulent or abusive, and refunds may be reduced by transaction fees we can't recover.
5.2 Your statutory cooling-off right
If you're a consumer in the UK, you have a statutory 14-day cancellation right for services bought online. By placing an order you expressly request that we begin providing the service straight away. If you cancel within the 14-day period after activation, we may deduct an amount proportionate to the service already provided. In practice, our 48-hour guarantee usually means you simply get a full refund. Nothing in these terms reduces your statutory rights.
5.3 Cancelling your service
When you cancel, you choose one of two options:
- Immediate: your service ends right away, and your box, data and backups are permanently deleted at that moment.
- End of billing period:your service keeps running until the end of the period you've paid for, then it's permanently wiped.
5.4 Missed payments
If an invoice isn't paid when due, your service is suspended. If it remains unpaid 3 days after the due date, the service is terminated and your data and backups are permanently deleted. Keep your payment details current if there's anything on your box you care about.
6. Chargebacks
Please come to us first: our refund policy exists so you never need to dispute a charge. Filing a chargeback instead of requesting a refund will result in immediate suspension or termination of all services on your account without refund, and we may refuse future service to the same person, account or payment method, including alternate accounts. A support response that arrives within our stated SLA is not grounds for a chargeback.
7. Windows licensing (BYOL)
Our cloud PCs ship with Windows 11 pre-installed but unactivated. Windows licensing is not included in your subscription: you bring your own licence and you are solely responsible for making sure your Microsoft licensing covers your use, including use in a hosted environment. Fire Power Cloud provides the infrastructure only, and any licensing breach is your liability, not ours.
8. Acceptable use
We can suspend or terminate services used in ways that create legal risk for us, break these terms, or endanger our ability to provide a reliable service to other customers. The list below is guidance, not an exhaustive catalogue. The following are prohibited:
- Illegal content: hosting, distributing or linking to content that breaks applicable law, including any content involving minors and pirated software or media.
- Resource abuse: deliberately consuming excessive CPU, memory, disk or network resources in a way that degrades performance for other customers.
- Denial-of-service activity: originating any form of DoS attack from our services, or using our services as a DoS target.
- Harmful traffic: spamming, mass emailing without consent, or running misconfigured applications that generate excessive outbound traffic.
- Scanning and intrusion: port scanning, IP mapping or any tooling used to find or exploit vulnerabilities, gain unauthorised access, or distribute malware.
- File dumps: hosting file dump or mirror scripts, or large file-sharing hubs. Torrenting is allowed strictly for legal, non-copyrighted material, and we reserve the right to investigate torrenting activity.
- Cryptocurrency mining without our explicit written permission.
- High-risk hosting: botnets, illegal streaming services, or remote desktop services used for malicious purposes.
- Anything else that harms our ability to provide reliable services or exposes us to undue legal or financial risk.
You get full administrator access to your cloud PC. That access doesn't exempt you from any of the above: misuse of it is treated the same as any other violation, up to and including termination.
9. Your content
You can store, publish and distribute content through our services, including on websites you host ("User Content"). You are solely responsible for all User Content and for any transactions or activity conducted through your services. By storing or distributing User Content, you confirm that you hold all necessary rights to it and that it doesn't infringe the rights of Fire Power Cloud or any third party. Breaching this section can result in immediate termination.
Copyright complaints are handled under our DMCA policy.
10. Your data and backups
You are responsible for backing up your own data. We are not liable for loss of files or data, including during suspension, termination or cancellation. When your service ends, whether by cancellation, termination or non-payment, your box, data and backups are permanently deleted on the schedules set out in section 5, and we have no obligation to recover them afterwards.
11. Privacy and data protection
We comply with applicable data protection law, including UK GDPR. We collect and process the personal data needed to provide the service, such as account information, payment details and usage data, as described in our Privacy Policy. Personal data is kept only as long as needed or as the law requires, and you have the right to access, correct, delete or port it.
12. Monitoring
We monitor network traffic and hardware usage (CPU, RAM, disk, network) across our services to keep them secure and performing well, and to spot irregularities. We do not access the inside of your service without your explicit permission.
13. Service level agreement
13.1 Uptime
We guarantee 99.9% uptime per calendar month, excluding scheduled maintenance and events beyond our control.
13.2 Support
Support tickets are accepted 24/7/365, and we commit to a first response within 24 hours. Resolution times depend on the nature of the issue and are targets, not guarantees; outages and critical issues are always prioritised.
13.3 Scheduled maintenance
Scheduled maintenance is excluded from uptime calculations and announced at least 48 hours in advance, normally during off-peak hours.
13.4 Service credits
If we miss the uptime guarantee in a calendar month, you can claim:
- 99.9% to 99.5% uptime: a credit of 10% of that month's fee
- Below 99.5% uptime: a credit of 25% of that month's fee
To claim, open a support ticket titled "SLA Credit" within 30 days of the incident, including details of the issue. Credits are your sole remedy for SLA breaches.
13.5 Exclusions
This SLA does not cover:
- Issues caused by your own hardware, software or configuration
- Disruption from third-party integrations or external networks
- Force majeure events or conditions beyond our control
- Changes you made, or misuse of the service
14. Suspension and termination by us
We may suspend or terminate any service at our sole discretion, with or without a stated reason. On suspension or termination, your right to use the service ends immediately. Any refund after that point is at the discretion of our administration team, and section 10 applies to your data.
15. Our intellectual property
All content and materials on firepower.cloud and its subdomains, including text, graphics, code, images, logos and the site name, belong to Fire Power Cloud LTD or their respective owners and are protected by copyright and trademark law. Don't reproduce, distribute or reuse them without our permission.
16. Fair usage
Some of our services include unlimited resources, such as unlimited bandwidth. "Unlimited" means unmetered for normal use, not infinite. If usage is inconsistent with these terms or harms other customers, we may limit or restrict it. We'll only do so after careful consideration and in line with our policies and the law.
17. Disclaimers
Our services are provided "as is" and "as available". We don't warrant that they will meet your specific requirements, be uninterrupted, timely, secure or error-free, or that any information obtained through them will be accurate or reliable. Anything you download through our services is at your own risk. No advice or information from us creates any warranty beyond what is expressly stated in these terms. None of this affects your statutory rights as a consumer.
18. Limitation of liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.
Subject to that:
- We are not liable for indirect or consequential loss, loss of profits, loss of business, loss of data, or loss of goodwill.
- Our total liability to you, in contract, tort or otherwise, is capped at the fees you paid us in the 3 months before the event giving rise to the claim.
19. Indemnity
You will indemnify Fire Power Cloud LTD against claims, damages and costs (including reasonable legal fees) arising from your User Content, your breach of these terms, your breach of applicable law, or activity on your account or assigned IP address.
20. IP addresses
You are responsible for the use and security of the IP address assigned to your service while it's yours. We may change your assigned IP address for operational, security or other legitimate reasons, with 30 days' notice.
21. Changes to these terms
We may update these terms from time to time. For material changes, we'll give you at least 14 days' notice by email or through the client portal before they take effect. Continuing to use the service after that date means you accept the updated terms.
22. General
- Governing law:these terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you're a consumer, this doesn't take away protections you're entitled to in your country of residence.
- Severability: if any part of these terms is found unenforceable, the rest still applies.
- Entire agreement: these terms, together with our Privacy Policy and DMCA policy, are the whole agreement between us.
- Assignment: we may transfer our rights and obligations under these terms; you may not transfer yours without our consent.
- Force majeure:we're not responsible for failures caused by events beyond our reasonable control, such as power or network failures outside our infrastructure, natural disasters, or actions of governments.
