DMCA Notice & Takedown Policy
Digital Millennium Copyright Act Compliance
1. Policy Overview
Fire Power Cloud LTD is an online service provider as defined in the Digital Millennium Copyright Act (DMCA). We provide legitimate users with the ability to host and distribute content through our cloud computing services. We respect intellectual property rights and take copyright infringement seriously.
Fire Power Cloud LTD does not monitor, screen, or otherwise review the content uploaded to our servers by users of the service. However, we will vigorously protect the rights of legal copyright owners and respond promptly to valid DMCA takedown notices.
If you are the copyright owner of content which appears on the Fire Power Cloud LTD infrastructure and you did not authorize the use of the content, you must notify Fire Power Cloud LTD in writing in order for us to identify the allegedly infringing content and take appropriate action.
2. Filing a DMCA Takedown Notice
To file a valid DMCA takedown notice, you must provide written notification that includes all of the following information:
2.1 Required Information
Your written notice must include the following elements:
- Physical or Electronic Signature: A physical or electronic signature of the copyright owner or person authorized to act on behalf of the owner of an exclusive right that is allegedly being infringed
- Identification of Copyrighted Work: Specific identification of the copyrighted work claimed to have been infringed. If you are alleging infringement of multiple copyrighted works, you must submit a representative list which specifically identifies each of the works
- Location of Infringing Material: Specific identification of the location and description of the material that is claimed to be infringing, with enough detailed information to permit Fire Power Cloud LTD to locate the material. You should include the specific URL or URLs where the allegedly infringing material is located
- Contact Information: Information reasonably sufficient to allow Fire Power Cloud LTD to contact the complaining party, including name, address, telephone number, and electronic mail address
- Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
2.2 Submission Methods
DMCA notices must be submitted to our designated DMCA agent through one of the following methods:

- Support Ticket: Through our customer portal with the subject "DMCA Takedown Notice"
2.3 Response Timeline
Upon receipt of a valid DMCA notice, Fire Power Cloud LTD will:
- Acknowledge receipt within 24 hours
- Remove or disable access to the allegedly infringing material expeditiously
- Notify the affected customer of the takedown
- Provide the customer with a copy of the DMCA notice
3. Filing a DMCA Counter-Notice
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a counter-notice with us.
3.1 Counter-Notice Requirements
A valid counter-notice must include:
- Your Signature: Your physical or electronic signature
- Identification of Material: Identification of the material that has been removed or disabled and the location where it appeared before removal
- Good Faith Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Consent to Jurisdiction: Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Fire Power Cloud LTD may be found)
- Service of Process: A statement that you will accept service of process from the person who provided the original DMCA notice or an agent of such person
3.2 Counter-Notice Process
Upon receipt of a valid counter-notice:
- We will promptly provide the person who filed the original DMCA notice with a copy of the counter-notice
- We will inform that person that we will replace the removed material or cease disabling it in 10 business days
- We will replace the removed material or cease disabling access to it between 10 and 14 business days after receipt of the counter-notice, unless our designated agent receives notice that the original complainant has filed a court action seeking a restraining order
4. Repeat Infringer Policy
Fire Power Cloud LTD maintains a policy of terminating, in appropriate circumstances, users who are repeat infringers. We may also at our sole discretion limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
4.1 Three-Strike Policy
Users who receive three valid DMCA takedown notices may have their services terminated without refund. We reserve the right to terminate services after fewer violations if circumstances warrant.
5. False Claims and Misrepresentation
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. This includes both false claims of infringement and false claims that material was removed or disabled by mistake.
Fire Power Cloud LTD reserves the right to seek damages from any party that submits a frivolous or bad faith DMCA notice or counter-notice.

7. Additional Information
7.1 Processing Time
We process DMCA notices in the order they are received. Complex cases may require additional time for review. We will keep you informed of the status of your notice.
7.2 Non-US Copyright Claims
While this policy is based on US DMCA law, we respect copyright laws of all jurisdictions and will consider valid copyright claims from rights holders worldwide.
